Terms of Use
These Terms of Use (“Terms”) are a binding agreement between you and The Grill Hype, operator of the The Grill Hype publication (“The Grill Hype,” “we,” “us,” or “our”). They govern your access to and use of our website, content, and related services (the “Services”). Please read them carefully.
1. Acceptance of these Terms
By accessing or using the Services, creating an account, or clicking to accept, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Services or create an account. By using the Services you represent that you meet this requirement and that you are able to form a binding contract with us.
3. Your account
- You may register with an email address and password, or by using Sign in with Google. You agree to provide accurate information and to keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at legal@thegrillhype.com if you suspect unauthorised access.
- We may require you to verify your email address before you can use certain features, such as commenting.
- You may delete your account at any time from your account settings or by contacting us.
4. Acceptable use
You agree that you will not:
- break any applicable law, or infringe anyone’s rights, including intellectual property or privacy rights;
- post content that is unlawful, defamatory, harassing, hateful, threatening, obscene, or that incites violence;
- impersonate any person or misrepresent your affiliation;
- upload malware, or attempt to gain unauthorised access to the Services, other accounts, or our systems;
- probe, scan, or test the vulnerability of the Services, or circumvent our security, authentication, or rate-limiting measures;
- scrape, harvest, or use bots to collect data or content except as expressly permitted in writing;
- use the Services to send spam or unsolicited marketing; or
- interfere with or disrupt the integrity or performance of the Services.
5. User content
“User Content” means anything you submit, such as comments, replies, or a profile name and avatar. You retain ownership of your User Content.
By submitting User Content, you grant The Grill Hype a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, adapt (for formatting and moderation), and distribute that content in connection with operating and promoting the Services. This licence ends when you delete your User Content, except for reasonable backup copies and content others have already shared.
You represent that you own or have the rights to your User Content and that it does not violate Section 4. You are solely responsible for your User Content.
We are not obligated to monitor User Content, but we may review, moderate, edit, or remove it, and may suspend or terminate accounts, at our discretion - particularly content that violates these Terms. Comments are public; do not post anything you would not want seen publicly.
6. Our content and intellectual property
The articles, photography, graphics, logos, the The Grill Hype and “The 4orge” names, and the look and feel of the Services are owned by The Grill Hype or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable licence to access and read our content for your own non-commercial use.
You may share links to our articles and quote brief excerpts with attribution. You may not republish, redistribute, sell, or create derivative works from our content without our prior written permission. Press and licensing enquiries: legal@thegrillhype.com.
7. Newsletter and communications
If you subscribe to our newsletter or opt in to marketing, you consent to receive those emails. You can unsubscribe at any time using the link in any email or through your account settings. We will still send you essential account and security messages (such as verification and password-reset emails) as part of providing the Services.
8. Third-party services and links
The Services rely on and link to third parties (for example, Google sign-in and embedded media). Your use of those services is governed by their own terms and policies. We are not responsible for third-party content or services.
9. Editorial content is not professional advice
Our journalism and commentary are provided for general information. They are not legal, financial, medical, or other professional advice, and should not be relied on as such. Always seek a qualified professional for your situation.
10. Disclaimers
To the fullest extent permitted by law, the Services and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that content is accurate, complete, or current.
11. Limitation of liability
To the fullest extent permitted by law, The Grill Hype and its officers, employees, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or reputation, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim (which for free use is zero) or USD 100.
Some jurisdictions, including Nigeria, do not allow certain limitations of liability; in those places the limitations above apply only to the extent permitted, and nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
12. Indemnification
You agree to indemnify and hold harmless The Grill Hype and its officers, employees, and contributors from any claims, losses, liabilities, and reasonable expenses (including legal fees) arising from your User Content, your use of the Services, or your breach of these Terms or of any law or third-party right.
13. Governing law and dispute resolution
These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws rules. The Grill Hype is based in the Federal Capital Territory (FCT), Abuja. If you use the Services from outside Nigeria, nothing in these Terms deprives you of any protection you are entitled to under the mandatory consumer-protection or data-protection law of the place where you live.
Informal resolution first. Most problems can be sorted out quickly. Before starting any formal proceeding, please email legal@thegrillhype.com with a description of the issue so we can try to resolve it within 30 days.
Forum. If we cannot resolve a dispute informally, you and we agree that it will be subject to the exclusive jurisdiction of the competent courts of the Federal Capital Territory, Abuja, Nigeria. By mutual written agreement, a dispute may instead be referred to arbitration in Abuja under the Arbitration and Mediation Act 2023, conducted in English by a single arbitrator. This does not stop either party from seeking urgent injunctive relief from a court, and it does not override any non-waivable right to bring proceedings in your home jurisdiction.
14. Suspension and termination
We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, if required by law, or to protect the Services or other users. You may stop using the Services and delete your account at any time. Sections that by their nature should survive termination - including Sections 5, 6, 10, 11, 12, and 13 - will survive.
15. Changes to the Services and these Terms
We may modify or discontinue features at any time. We may also update these Terms; when changes are material we will update the “Last updated” date and, where appropriate, notify you. Your continued use after an update means you accept the revised Terms. If you do not agree, stop using the Services.
16. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Notices. Legal notices to us should go to legal@thegrillhype.com.
